This website grants you non-exclusive limited license to use the Ivory Search plugin and other products offered through this website (https://ivorysearch.com) (the “products/software”) in accordance with these Terms & Conditions (the “license”) issued herein.
Privacy Policy
Conditions related to purchasing are also covered in the Privacy Policy. Note that as a Ivory Search customer your email address will be added to a notification list for Ivory Search customers. You can opt out of this method of contact at any time by clicking the Unsubscribe link contained in all correspondence or contacting admin@ivorysearch.com and making a formal request. As per the Privacy Policy when you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Plugin Licensing
Ivory Search is licensed under the GNU general public license (http://www.gnu.org/licenses/gpl.html).
Automatic Upgrades
Automatic Upgrades are available to free plugin users and also to customers who have purchased a license in accordance with the license they have purchased. Depending on the license you have purchased the upgrades are provided to one site, five site or twenty five sites owned by you or your clients. You may not share or resell access to your license key.
Licenses remain active for 1 year after purchase. After 1 year either a license renewal or a new license will need to be purchased in order to continue receiving support and product upgrades.
Delivery
After payment has been successfully processed, you will be directed to a copy of your receipt that contains the applicable download link(s). This receipt will also be emailed to you. This may take up to 1 hour to arrive, but usually happens instantly when placing the order. If you do not receive an email after this time period, please send an email.
Ownership
You may not claim intellectual or exclusive ownership rights to any Ivory Search products. All products are property of Ivory Search. They are provided “as is” without warranty of any kind, expressed or implied. Ivory Search shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use these products.
Site Content
All site content, including imagery and documentation that is published on ivorysearch.com is the property of Ivory Search. Any replicated site content must be authorized in advance. Content from this site shall not be used or exploited for commercial or non-commercial purposes without the prior written consent of Ivory Search.
Refunds
Ivory Search offers refunds on software within 30 days of purchase. Before requesting a refund, please use the Contact Us tab on the Ivory Search settings screen within your WordPress Dashboard to open a support ticket so that we can help you.
Refunds will be offered at our sole discretion and must meet all of the following conditions fully:
- You are within the first 30 days of the purchase of the plugin.
- You have attempted to resolve your issue(s) with our support team by opening a support ticket through the “Contact Us” in the plugin’s admin settings.
By upgrading, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment or legal actions.
This policy does not cover refunds for the following cases:
- Missing feature(s)
- 3rd part conflict
- Discovering a better alternative
- Customer changed their mind
Refunds ARE NOT provided for renewals.
Support
Ivory Search offers WordPress plugins “as is” and with no implied meaning that they will function exactly as you would like or will be compatible with all 3rd party components and plugins. Ivory Search does not offer support via email outside of the support system built into Ivory Search itself or otherwise support WordPress or other WordPress plugins Ivory Search has not developed.
Support is available with an active license key. Purchasing a license gives you access to the support area built into the plugin and on this website. Support and automatic product updates are provided for a term of 1 year from the date of purchase. After 1 year a new license will need to be renewed in order to continue receiving support and product updates. Ivory Search reserves the right to refuse support service for any reason (including subject matter) and a full refund will be offered.
License holders cannot distribute, freely give away, or resell their license key. The license key is only transferable by contacting us and requesting an official transfer of the license to a new owner. The license is intended to be used on the license holders web site(s). Client site usage is permitted in situations where the license holder maintains an ongoing relationship with the client as a consultant. Providing Ivory Search as a service does not constitute a client relationship. Only the license holder is permitted to request support or access support resources.
License holders are not permitted to re-post content generated from support interactions or documentation on any external websites, social media outlets, etc. Posting screen captures of this content is also prohibited. Violation will be grounds for immediate termination of the license and all access to support content and product updates will be discontinued.
Indemnity
You agree to indemnify and hold harmless Ivory Search for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this license.
Price Changes
Ivory Search reserves the right, at any time, to modify or discontinue, temporarily or permanently, a support license with or without notice. Prices of all products are subject to change. Notice of price changes will be made on the site.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We may terminate or suspend your license key immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your license key, you can do so by simply emailing us and we’ll cancel your license key with immediate effect.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Warranty
THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, IVORY SEARCH DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.
This plugin is guaranteed to function on a clean installation of WordPress. Ivory Search does not guarantee it will function with all 3rd party plugins or with all web browsers. Ivory Search is not responsible for any plugin compatibility conflicts that may occur. It is the policy of Ivory Search to support my plugins as best as possible and support for 3rd party plugin conflicts will be provided at the discretion of Ivory Search or as time allows. Ivory Search is not responsible for any data loss or data exposure that may occur as a result of installing this plugin.
Limitations Of Liability
YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS OF THE SOFTWARE BE LIABLE FOR CLAIMS, DAMAGES OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE. LICENSE HOLDERS ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USE AND ASSUME ALL RISKS ASSOCIATED WITH ITS USE, INCLUDING BUT NOT LIMITED TO THE RISKS OF PROGRAM ERRORS, DAMAGE TO EQUIPMENT, LOSS OF DATA OR SOFTWARE PROGRAMS, OR UNAVAILABILITY OR INTERRUPTION OF OPERATIONS.
